There have been several challenges to these Executive Orders and agency actions, resulting in court decisions that may impact administration of federal funding.<\/p>\n<p>Most recently, on 8\/07\/2025 an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/08\/improving-oversight-of-federal-grantmaking\/\" target=\"_blank\" rel=\"noopener\">Executive Order on Improving Oversight of Federal Grantmaking<\/a> was issued. The UW is closely monitoring federal agency implementation.<\/p>\n<p>Any PIs receiving agency communications related to specific award changes should create an <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/\">OSP &amp;GCA Award Modification in SAGE<\/a>, and then forward these to the Office of Sponsored Programs (OSP), emailing <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>, along with the MOD#.<\/p>\n<p>The Office of Research is tracking <a href=\"\/research\/faq\/federal-agency-updates-links-memos\/\">select federal court decisions, links and memos<\/a>.<br \/>\n<a name=\"proposals\"><\/a><\/p>\n<h2>Proposals<\/h2>\n<p><a name=\"sponsor-systems\"><\/a><\/p>\n<h3>Sponsor Systems and Due Dates<\/h3>\n<p>Check your funding announcement for any revisions or updates, including updated terms and conditions or the opportunity expiration date.<br \/>\n<a name=\"idc\"><\/a><\/p>\n<h3>Indirect Cost Rate<\/h3>\n<p>Use UW\u2019s federally negotiated indirect cost (IDC) rates until further notice. Any opportunity that includes an IDC cap will be scrutinized. Review select specific agency information:<\/p>\n<ul>\n<li><strong>National Institutes of Health (NIH)<\/strong>: NIH issued an IDC cap policy. This IDC cap policy is under a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.280590\/gov.uscourts.mad.280590.105.0_2.pdf\" target=\"_blank\" rel=\"noopener\">preliminary injunction<\/a>. Use UW\u2019s federally negotiated rate.<\/li>\n<li><strong>National Science Foundation (NSF)<\/strong>: <strong>UPDATE 6\/20\/2025<\/strong> <a href=\"https:\/\/www.courtlistener.com\/docket\/70143919\/78\/association-of-american-universities-v-national-science-foundation\/\" target=\"_blank\" rel=\"noopener\"><u>Court declares that the NSF&#8217;s 15% Indirect Cost Rate and the Policy Notice are invalid, arbitrary and capricious, and contrary to law.<\/u><\/a> The UW will submit proposals to NSF opportunities using UW\u2019s current negotiated rates.<\/li>\n<li><strong>Department of Energy (DOE)<\/strong>: DOE issued an IDC cap policy. As of 7\/01\/2025:<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.283318\/gov.uscourts.mad.283318.71.0.pdf\" target=\"_blank\" rel=\"noopener\"> Court decision has vacated IDC Cap policy (Policy Flash 2025-22) in its entirety<\/a>. Use UW\u2019s federally negotiated rate.<\/li>\n<li><strong>Department of Defense (DoD)<\/strong>: DoD issued an IDC cap memo on 6\/12\/2025. A <a href=\"https:\/\/www.courtlistener.com\/docket\/70552058\/73\/association-of-american-universities-v-department-of-defense\/\" target=\"_blank\" rel=\"noopener\">preliminary injunction is in place as of 7\/18\/2025<\/a>. \u00a0Please review our <a href=\"\/research\/announcements\/federal-administration-updates\/\">announcement on impacts to proposals and awards<\/a>.<\/li>\n<\/ul>\n<p>Make sure to include in the eGC1 all communicated requirements from a sponsor.<\/p>\n<p>Always list the relevant <span style=\"font-weight: 400;\">URL for the Request For Proposal (RFP)<\/span> in the eGC1.<br \/>\n<a name=\"tc\"><\/a><\/p>\n<h3>Terms and Conditions<\/h3>\n<p>Watch for inclusion of new grantee eligibility requirements, terms and conditions and other requirements premised on executive orders. In accordance with <a href=\"https:\/\/policy.uw.edu\/directory\/po\/executive-orders\/eo-34-grant-and-contract-support-of-university-activities\/\" target=\"_blank\" rel=\"noopener\">UW Executive Order 34<\/a>, as the authorized signing official and as delegated by the Vice Provost for Research, only OSP approves, signs, and transmits proposals to sponsors on behalf of the ÁñÁ«ÊÓÆµ.<br \/>\n<a name=\"proposals-foreign-sub\"><\/a><\/p>\n<h3>Proposals with Foreign Subrecipients<\/h3>\n<p><a href=\"https:\/\/grants.nih.gov\/grants\/guide\/notice-files\/NOT-OD-25-155.html\" target=\"_blank\" rel=\"noopener\">NIH has communicated a new award structure<\/a>, with a subproject model, for projects involving foreign collaborations. More information is available on our <a href=\"\/research\/faq\/nih-faqs-2025\/\">NIH FAQs page.<\/a><\/p>\n<hr \/>\n<p><a name=\"post-submission\"><\/a><\/p>\n<h2>Post Submission<\/h2>\n<p>Various federal agencies are assessing funding priorities and making adjustments in operations in response to executive orders and directives. We are aware that there are severe delays in agencies making funding decisions and issuance of funding.<\/p>\n<p>If a federal agency emails a PI with the option to revise recent proposals to remove or change programmatic sections within the proposal, the change may be minor and acceptable to PIs or it may raise concerns. If the PI wants to evaluate if such request is consistent with current legal proceedings, please contact the Office of Sponsored Programs at <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>.\u00a0In no circumstance should a PI make a statement, assurance or certification on behalf of the University regarding compliance with federal policy. If faced with that request, please contact OSP.<\/p>\n<p>If a revised proposal will be submitted, or a response to a sponsor submitted, please follow the processes for these actions:<\/p>\n<ul>\n<li>Revised proposals require a <a href=\"\/research\/faq\/need-use-egc1\/\">revised eGC1<\/a>.<\/li>\n<li><a href=\"\/research\/myresearch-lifecycle\/plan-and-propose\/submit-proposal\/post-submission\/#supp\">Pre-award correspondence<\/a> should be submitted to OSP via <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>.<\/li>\n<\/ul>\n<hr \/>\n<p><a name=\"advance-spend\"><\/a><\/p>\n<h2>Advance Spend<\/h2>\n<h3>New Requests:<\/h3>\n<p>New Advance Spend or Temporary Internal Extension requests are allowed for up to 120 days. Please review <a href=\"https:\/\/finance.uw.edu\/gca\/award-lifecycle\/award-setup\/advance-awards\" target=\"_blank\" rel=\"noopener\">GCA\u2019s Advance Award guidance<\/a>.<\/p>\n<h4 style=\"padding-left: 40px;\">Duration<\/h4>\n<p style=\"padding-left: 40px;\">Approved extensions will generally not exceed a total of 120 days unless otherwise authorized by GCA or OSP based on confirmed sponsor communication and demonstrated need.<\/p>\n<h4 style=\"padding-left: 40px;\">Administrative Flexibility for Month-End Variances<\/h4>\n<p style=\"padding-left: 40px;\">Due to timing differences between calendar month-end dates and standard 30- or 60-day advance periods, slight variances (e.g., 1\u20132 days) may occur. GCA and OSP may exercise administrative flexibility when such variances are minimal and do not materially increase financial risk.<\/p>\n<h4 style=\"padding-left: 40px;\">Financial Responsibility<\/h4>\n<p style=\"padding-left: 40px;\">All expenditures incurred during the advance spend period remain the responsibility of the department, school, or college until the official award has been fully executed and activated in Workday.<\/p>\n<p>For cases where an Advance period is already in place and no exceptional circumstance applies, a pause on expenditures must occur when the advance spend period ends. When the Advance Award is paused, departments must identify alternate funding or initiate temporary HR actions. For guidance, work with your HR consultant and see <a href=\"https:\/\/hr.uw.edu\/fedpolicy\/\" target=\"_blank\" rel=\"noopener\">HR Support Resources for Federal Policy Impact<\/a>.<\/p>\n<hr \/>\n<p><a name=\"awards\"><\/a><\/p>\n<h2>Awards<\/h2>\n<p><a name=\"reports\"><\/a><\/p>\n<h3>Reports<\/h3>\n<p>Stay on top of timely submissions per standard instructions in your award.<br \/>\n<a name=\"scope-revisions\"><\/a><\/p>\n<h3>Scope Revisions<\/h3>\n<p>Some PIs are receiving notices to cease award activities that have become noncompliant with the new Executive Orders, either specific to a particular project or via a broad message from the agency. If you do receive a request for scope changes that requires you to send in a formal revised Statement of Work (SOW), then the revision must be submitted through OSP using the <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/\">SAGE (MOD) process<\/a>.<\/p>\n<p>Please create an <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/#other-changes\">OSP &amp; GCA MOD, select \u201cOther Changes\u201d<\/a> tab, and the subcategory of \u201cExecutive Branch Directive Change\u201d. OSP is ensuring there is review of such requests prior to submission, in light of the TRO and Motion to Enforce. This information is also being shared with the AG\u2019s office.<\/p>\n<p><span style=\"font-weight: 400;\">If an agency sends a request for changes through a broad directive there is no need to send changes through OSP on an Award Modification. You may continue to send any broad agency communications to <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>, for awareness. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Questions about specific activities on your project should be directed to your program manager. Please document any communications that you have with your program manager associated with scope changes.<\/span><br \/>\n<a name=\"terms-or-award-changes\"><\/a><\/p>\n<h3>Terms or Award Changes<\/h3>\n<p>We anticipate changes to sponsor requirements for compliance, certifications made by the UW as a grantee\/contractor, and award reporting.<\/p>\n<p>Changes may come from a sponsor as a blanket change, by memo, or newly implemented policy. Others may be through individual award amendment. They may be imposing or lifting restrictions. You may also receive informal instructions directly from your Program Officer. In no circumstance should a PI make a statement, assurance or certification on behalf of the University regarding compliance with federal policy. If faced with that request, please contact OSP (<a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>). If you receive any individual amendment or other specific award change instructions, please submit them as an <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/#other-changes\">OSP &amp; GCA Award Modification (MOD)<\/a> in SAGE select \u201cOther Changes\u201d tab, and the subcategory of \u201cExecutive Branch Directive Change\u201d. A PI should refer to <a href=\"\/research\/policies\/uw-statement-on-foreign-subrecipient-assessment-tracking-and-monitoring\/\">UW\u2019s Statement on Foreign Subaward Assessment, Tracking and Monitoring<\/a> for important institutional level information.<\/p>\n<p><a name=\"extensions\"><\/a><\/p>\n<h3>Extensions<\/h3>\n<p>All requests to extend a project go through OSP.<\/p>\n<p><a name=\"stop-or-suspend-work-order\"><\/a><\/p>\n<h3>Stop or Suspend Work Orders<\/h3>\n<p>A stop or suspend\/pause work order may come to the PI or the PI\u2019s department, or it may come to OSP or GCA. Irrespective of whether the change order is dated before or after the TRO went into place, these guidelines must be followed to ensure proper consideration. Please note that action should be taken as soon as possible \u2013 and within 24 hours.<\/p>\n<ul>\n<li><strong>If GCA receives a stop\/pause work order<\/strong>, they should forward it immediately to <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a>.<\/li>\n<li><strong>When OSP receives a stop\/pause work order<\/strong>, an Award Modification will be created and routed to the PI within 24 hours for awareness and additional information. If the change order appears inconsistent with the TRO, OSP will confirm with the sponsor before processing the Award Modification.<\/li>\n<li><strong>If a PI or their department receive a stop\/pause work order<\/strong>, the PI must create the <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/\">OSP &amp; GCA Award Modification<\/a> within 24 hours of being notified. Choose \u201cOther Changes\u201d, and the subcategory of \u201cStop work Order\u201d in creating the MOD. Include the sponsor communication along with any required documents, identify the sponsor deadline, and route to OSP. Please also email <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a> with the MOD #.<\/li>\n<\/ul>\n<p>Within 24 hours of being notified, the PI must contact their department administration, dean\u2019s office and central HR consultant to initiate processes for expenditure management.<\/p>\n<p>Please review <a href=\"https:\/\/hr.uw.edu\/fedpolicy\/\" target=\"_blank\" rel=\"noopener\">UW Human Resources information<\/a>.<\/p>\n<p>Guidance is available for researchers who have changes related to research involving <a href=\"\/research\/announcements\/hsd-swo\/\">human subjects<\/a> or <a href=\"https:\/\/sites.uw.edu\/oawrss\/potential-stop-work-order-instructions\/\">animals<\/a>.<\/p>\n<p><a name=\"resume-work\"><\/a><\/p>\n<h3>Resuming Work<\/h3>\n<p>Resumption of work authorization may happen in these two situations:<\/p>\n<ol>\n<li>A court decision that is determined to cover an earlier suspension order from the agency. When this occurs, the agency is required to send a broad notice to grantees. Upon receipt of that notice, resumption of work may occur. This still incurs risk if payment is delayed or suspended despite the court order. The University reserves the right to continue a suspension of work if it observes agency violation of the court order.<\/li>\n<li>For federal contracts and pass-through funding, we need formal notification to resume work. If you directly receive a specific resumption notice for your award, please submit it as an <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/\">OSP &amp; GCA Award Modification<\/a> in SAGE, choosing \u201cOther Changes\u201d as the Category, and \u201cResume Work Order\u201d as the subcategory. Be sure to attach the specific award notice to the MOD. Please let <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a> know the MOD#.<\/li>\n<\/ol>\n<p><a name=\"early-termination\"><\/a><\/p>\n<h3>Early Termination<\/h3>\n<p>In some instances, we are seeing early termination of active federal and federal flow-through awards. If received, please submit as an <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/\">OSP &amp; GCA Award Modification<\/a> in SAGE, choosing \u201cSchedule Change\u201d and the subcategory of \u201cEarly Termination\u201d.\u00a0 Please let <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a> know the MOD #. Please review <a href=\"https:\/\/hr.uw.edu\/fedpolicy\/\" target=\"_blank\" rel=\"noopener\">UW Human Resources information<\/a>.<\/p>\n<p>Additional guidance is available for researchers who have changes related to research involving <a href=\"\/research\/announcements\/hsd-swo\/\" target=\"_blank\" rel=\"noopener\">human subjects<\/a> or <a href=\"https:\/\/sites.uw.edu\/oawrss\/potential-stop-work-order-instructions\/\" target=\"_blank\" rel=\"noopener\">animals<\/a>.<\/p>\n<p>Please review <a href=\"https:\/\/finance.uw.edu\/pafc\/spending\/specific-cost-items\/closeout-termination-costs\" target=\"_blank\" rel=\"noopener\">Closeout steps<\/a> as well as guidance on <a href=\"https:\/\/finance.uw.edu\/pafc\/spending\/specific-cost-items\/closeout-termination-costs\" target=\"_blank\" rel=\"noopener\">Closeout and Termination Costs<\/a>.<\/p>\n<h4>Appeals<\/h4>\n<p>PIs must work with their department and school\/college leadership to review the information provided in the termination notice to determine whether to appeal.<\/p>\n<p>OSP is responsible for submitting the appeals to a sponsor. OSP will work with the PI in developing the justification. Note that all charges to the project must be suspended during the appeal process.<\/p>\n<p>Contact OSP at <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a> for appeal inquiries.<\/p>\n<p><a name=\"spending\"><\/a><\/p>\n<h3>Spending &amp; Expenditure Management<\/h3>\n<p>Most activity on your federal awards can continue if there is not a stop work order or termination. However, in some cases, the University is observing a delay or suspension of payments. In those cases, the award activity may need to pause while decisions on next steps occur.<\/p>\n<p>For stop\/pause work orders, some scope changes, and severely delayed payments, there will be impacts on employee salary support. If there are insufficient other funding sources to cover salary for an employee, the department must initiate a furlough or layoff. Please work with your Department and School when making these decisions.<\/p>\n<p>Any expenditures benefiting the project incurred after the effective date of the stop\/pause work order must be charged to an alternative spending source. Projects with a stop or pause work order will also have a hiring freeze.<\/p>\n<p><a name=\"subawards\"><\/a><\/p>\n<h2>Subawards<\/h2>\n<p>Subawards will continue to be processed as usual. Additional terms and conditions may apply.<\/p>\n<p>OSP will be actively monitoring change orders for outgoing subawards and will consider broad agency announcements in issuing subawards.<\/p>\n<p>These guidelines are applicable to all subawards, whether or not the subrecipient is foreign or domestic.<\/p>\n<h3>Subaward: Assurance Letters<\/h3>\n<p>During this period of uncertainty, OSP will no longer be issuing assurance letters to subrecipients on federal funding prior to subaward set-up.<\/p>\n<h3>Subawards: Stop work\/Suspension Orders<\/h3>\n<p>When there is a stop or suspend work order for a specific project:<\/p>\n<ul>\n<li>OSP will issue suspension letters to active subrecipients &amp; intended subrecipients consistent with the direction of the sponsor. The UW PI and SAGE Subaward Preparer will be copied on the email to the Subrecipient PI and contact.<\/li>\n<li>You do not need to send a subaward request to suspend a subaward. Subawards that have not been processed yet will continue to be processed to cover activity up to the stop work date.<\/li>\n<\/ul>\n<h3>Subawards: Change of Scope<\/h3>\n<p>When there is no stop work order, but the agency has issued an amendment ceasing activities associated with categories of recent Executive Orders, and this impacts the subaward:<\/p>\n<ul>\n<li>Submit a request to modify the Subaward in the SAGE Subawards Module.\n<ul>\n<li>Indicate the need for a subaward scope and\/or budget change.<\/li>\n<\/ul>\n<\/li>\n<li>Include any relevant attachments &amp; information from the sponsor.<\/li>\n<\/ul>\n<h3>Subaward: Early Terminations<\/h3>\n<p>When a federal agency issues an early termination for a project and there are subawards:<\/p>\n<ul>\n<li>Follow guidance on requesting an <a href=\"#early-termination\">Early Termination<\/a> MOD in SAGE<\/li>\n<li>Submit a request to modify the Subaward in the SAGE Subawards Module\n<ul>\n<li>Indicate the new end date<\/li>\n<li>Include any budget changes<\/li>\n<li>Include all relevant attachments &amp; communications with the sponsor<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>If you have questions about a subaward change order, please email <a href=\"mailto:ospsubs@uw.edu\">ospsubs@uw.edu<\/a>.<\/p>\n<h3>Foreign Subawards<\/h3>\n<p>The UW continues to partner with foreign collaborators.<\/p>\n<ul>\n<li>NIH has issued an Updated Policy on Foreign Subawards.
