Review information on the specific agreement before routing to OSP.<\/p>\n<p><span style=\"font-weight: 400;\"><\/p>\n<div class=\"accordion non-bold\" id=\"accessible-accordion\">\n<div class=\"screen-reader-text\">Accessible Accordion<\/div>\n<p><\/span><\/p>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Business Associate Agreement or BAA<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<ul>\n<li>Used when a Covered Entity shares data (Personal Health Information or Limited Data Set) to a <a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/guidance\/business-associates\/index.html\" target=\"_blank\" rel=\"noopener\">Business Associate<\/a><\/li>\n<li>Used when outgoing UW Medicine patient data will be provided to an entity that is <a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/privacy\/guidance\/business-associates\/index.html\" target=\"_blank\" rel=\"noopener\">considered a business associate under HIPAA<\/a> or when incoming patient data will be provided to the UW in its capacity as a business associate rather than for research purposes.<\/li>\n<\/ul>\n<p>OSP does not handle BAAs for outgoing patient data to a business associate. Review <a href=\"https:\/\/depts.washington.edu\/comply\/business-associates\/\" target=\"_blank\" rel=\"noopener\">BAA guidance from UW Medicine Compliance<\/a>.<\/p>\n<ul>\n<li>For BAAs related to VA services, submit <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a> with the agreement attached<\/li>\n<li>Sometimes, an agreement may be titled BAA but it is really a different type of agreement. If you are receiving Data for research and you were provided a BAA for this, please submit a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a> with the agreement attached<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Clinical Trial Agreement or Amendment<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Used when the UW will be a clinical trial site, and carry out the protocol per the terms of a clinical trial (CT) agreement. Changes to a CT\u00a0 agreement are by amendment.<\/p>\n<ul>\n<li>For clinical trials route an <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">After-the-Fact eGC1<\/a> with the agreement attached<\/li>\n<li>For changes to an existing clinical trial, create a SAGE Award Modification (OSP\/GCA) and follow instructions for <a href=\"\/research\/myresearch-lifecycle\/manage\/award-changes\/#cta-changes\">Clinical Trial Agreement changes\u00a0<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Confidential Disclosure Agreement (CDA)<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>These agreements restrict disclosure &amp; use of proprietary or protected info.<br \/>\nExamples:<\/p>\n<ul>\n<li>You are receiving confidential information from an outside party to consider entering into a research agreement relationship<\/li>\n<li>You are receiving protocol information for UW to be considered a clinical trial site<\/li>\n<li>You are sending confidential information to an outside party for that party to consider sponsoring your research<\/li>\n<\/ul>\n<p>Other types of similar agreements include Non-Disclosure Agreement (NDA) or Proprietary Information Agreement (PIA).<\/p>\n<p><strong>If the CDA is related to or in anticipation of a sponsored program:\u00a0<\/strong><\/p>\n<ul>\n<li>Route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a> with the agreement attached<\/li>\n<li>Review <a href=\"https:\/\/washington.edu\/research\/forms-and-templates\/sample-mutual-nda\/\" target=\"_blank\" rel=\"noopener\">UW Approved Mutual NDA Sample<\/a><\/li>\n<\/ul>\n<p><strong>If the CDA is related to an innovation you have disclosed:<\/strong><br \/>\nReview <a href=\"https:\/\/comotion.uw.edu\/licensing\/confidentiality-agreement\/\" target=\"_blank\" rel=\"noopener\">CoMotion CDA information<\/a>, or contact <a href=\"http:\/\/comotion.uw.edu\/contact-us\" target=\"_blank\" rel=\"noopener\">CoMotion<\/a><\/p>\n<p><strong>Neither?<\/strong> Contact your Chair, Dean, or Director<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Cooperative Research &amp; Development Agreements - CRADA<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Cooperative Research and Development Agreement (CRADA) are formal agreements between one or more Federal laboratories and one or more non-Federal parties under which:<\/p>\n<ul>\n<li>The government, through its laboratories, provides personnel, services, facilities, equipment, intellectual property, or other resources.<\/li>\n<li>No funds may be provided by the Federal laboratories to the non-Federal parties.<\/li>\n<li>The non-Federal parties may provide funds, personnel, services, facilities, equipment, intellectual property, or other resources toward the conduct of specified research or development efforts that are consistent with the missions of the bureau.<\/li>\n<li>Any property and equipment provided under technology transfer mechanisms will be provided in accordance with established property management policies and procedures.<\/li>\n<li>See more information on <a href=\"https:\/\/www.doi.gov\/techtransfer\/crada\" target=\"_blank\" rel=\"noopener\">CRADA<\/a> from the U.S. Dept. of Interior<\/li>\n<\/ul>\n<p>CRADA are generally non-negotiable.<\/p>\n<p>Route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a> with the CRADA agreement attached.<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Data Use Agreement - DUA | Data Transfer Agreement - DTUA<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Used for the transfer of data collected or developed such as raw data, data sets, student info, personal health info, etc.<\/p>\n<p style=\"padding-left: 40px;\">Examples:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Mutual disclosure of data between collaborators on a sponsored program<\/li>\n<li>One-way disclosure of UW data to an outside party as part of a consortium<\/li>\n<li>When the UW is a data coordinating center<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Related to an active or pending sponsored program?<\/strong><\/p>\n<ul>\n<li>Review <a href=\"https:\/\/washington.edu\/research\/myresearch-lifecycle\/setup\/collaborations\/sharing-information-and-data\/\">DUA guidance<\/a><\/li>\n<li>Route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a> with the agreement attached<\/li>\n<\/ul>\n<p><strong>All other DUAs: <\/strong>Contact your Chair, Dean, or Director<\/p>\n<p><strong>Need a DUA template?\u00a0 <\/strong>Use the <a href=\"https:\/\/thefdp.org\/demonstrations-resources\/dtuas\/\" target=\"_blank\" rel=\"noopener\">FDP DTUA Templates<\/a><\/p>\n<p><strong>Are you a UW Coordinating Center?<\/strong><br \/>\nContact <a href=\"mailto:osp@uw.edu\">osp@uw.edu<\/a> for consultation on template approval and management of high volume DUAs\/DSAs.<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Federal Data Repositories<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>When you are accessing or submitting data to a Federal Repository such as dbGaP, NIAGADS, CMS, and are required to complete a Data Submission Agreement (DSA), Data Access Request (DAR) or Data Use Certification (DUC) complete the following instructions.<br \/>\n<strong>Instructions:<\/strong><\/p>\n<ol>\n<li>In SAGE, find the award that is associated with the project that generated the data being submitted, or the project that will use the data in the case of a data access request.<\/li>\n<li>Create an Award Modification Request in SAGE to OSP\/GCA.<\/li>\n<li>Select Federal Data Repository Access &amp; Submission in the Other Changes section so it is routed to the correct reviewer.<\/li>\n<li>Attach the completed Federal Repository form.<\/li>\n<li>Include a <a href=\"\/research\/tools\/sage\/guide\/awards\/awards-comments-history\/#asr_and_mod_comment_examples\">comment<\/a> on the Modification that indicates what you are requesting.<\/li>\n<li>Submit the Award Modification Request in SAGE to OSP\/GCA.<\/li>\n<\/ol>\n<p><strong>NOTE<\/strong>: Before submitting human subjects datasets to repositories, consult with the Human Subjects Division <a href=\"mailto:hsdinfo@uw.edu\">hsdinfo@uw.edu<\/a><\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Fellowship Agreement \u2013 Industry and Onsite<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Postdoctoral support in which a portion of the training experience is carried out by an industry sponsor on-site at industry sponsor\u2019s location.<\/p>\n<p>Route an eGC1 in SAGE to OSP.<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Licensing or Loan Agreement \u2013 Third Party Software, Equipment, other<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>External party licensing software or equipment for UW use. Review the various situations to determine instructions \/ contact:<\/p>\n<ul>\n<li>If for use on a sponsored research agreement, route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a>.<\/li>\n<li>Purchasing software or equipment: If software or equipment are being acquired through purchase, normal procurement procedures should be followed. Procurement will advise on terms if needed.<br \/>\nIf license agreement rises to the level of an unfunded research agreement, route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGC1<\/a>.<\/li>\n<li>If for internally funded research or academic purposes, contact your Chair, Dean, or Director.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Master Agreement<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Overarching agreement in order to establish the terms and conditions that will be applicable to all projects and funding issued under the agreement. Typically, individual projects will be handled through a task order, work order, project addendum, or other shorter document that is subject to the terms of the overarching agreement.<\/p>\n<p>Route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\" target=\"_blank\" rel=\"noopener\">non-award agreement (NAA) eGC1<\/a>. Select a representative PI. This is the individual designated by involved schools\/colleges who will be responsible for the relationship with the sponsor overall. This PI may differ from PIs for individual work orders\/projects.<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Material Transfer Agreements (MTA)<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Transfer tangible (e.g. biological) material from or to the UW from or to an outside entity<\/p>\n<ul>\n<li>Incoming (to UW) Material and related to an active or pending sponsored program?\n<ul>\n<li>Route a <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/agreement-types\/after-the-fact-egc1-process\/\">non-award agreement (NAA) eGc1<\/a><\/li>\n<li>Review <a href=\"\/research\/myresearch-lifecycle\/setup\/collaborations\/sharing-material\/\">Sharing Materials<\/a> for more info<\/li>\n<\/ul>\n<\/li>\n<li>All other MTAs: review <a href=\"https:\/\/comotion.uw.edu\/what-we-do\/ip-advising-protection-and-licensing\/material-transfer-agreements-mta\/\">CoMotion MTA guidance<\/a><\/li>\n<li><span style=\"font-weight: 400;\">Purchasing materials: If materials are being acquired through purchase, normal procurement procedures should be followed. Procurement will advise on terms if needed.<\/span><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Outgoing Subawards<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>Review guidance for <a href=\"\/research\/myresearch-lifecycle\/setup\/subawards\/\">outgoing subawards<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"card\">\n<div class=\"card-header\" id=\"accordion-header\">\n<h3 class=\"mb-0\"><button class=\"btn btn-link\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse\" aria-expanded=\"false\" aria-controls=\"collapse\"><span class=\"btn-text\">Sponsored Research Agreement \u2013 Funded or Unfunded<\/span><span class=\"arrow-box\"><span class=\"arrow\"><\/span><\/span><\/button><\/h3>\n<\/div>\n<div id=\"collapse\" class=\"collapse \" aria-labelledby=\"collapse\" data-parent=\"#accordion\" role=\"region\">\n<p>The formal documentation between the UW and an external entity that memorializes the exchange transaction for a specific scope of work.<\/p>\n<p>Sponsors may provide funding, equipment or other tangible items for organized research, instruction, and other sponsored activity.<\/p>\n<p>The award terms must be followed for the life of the project and include project dates, restrictions and reporting.<\/p>\n<p>All sponsored research agreements <a href=\"#atf\">require an eGC1<\/a>.
